Question for New York State framers

What am I? New York State has decided that all businesses collecting state sales tax be classified under the "NAICS Code for Principal Business Activity." Ok, I am a picture framer. I frame pictures. I am not an art dealer, or anything else, for that matter. I frame pictures.

Here are some of my choices:

339900 Other Miscellaneous Mfg
442299 All other home furnishings stores
453998 All other miscellaneous Store retailers (including candle & trophy shops)
54510 Interior Design Services

or my favorite,
238130 Framing Contractors (unfortunately this seems to apply to the world of construction)

I have to choose a designation by Friday - HELP!!! :eek:
 
I would start selling candles and go with this; 453998 All other miscellaneous Store retailers (including candle & trophy shops). Trophies require too much equipment, so I wouldn't add them to the line.


P.S. In all seriousness, 339900 Other Miscellaneous Mfg., might be O.K./
442299 All other home furnishings stores, I would think would only cover buying and selling NOT Making (which I'm assuming you do./
453998 All other miscellaneous Store retailers (including candle & trophy shops), would be a good fit./ but
54510 Interior Design Services, I don't think fits at all.
 
Find out which category has the lowest Workmans Comp rating. In fact, contact your workmans comp carrier-they will tell which classification you are.

But, if you have choice, go with the lowest rate

The category I am under is Misc. Store Retailers, #453998 (All other miscellaneous store retailers)

I think the main need for this classification is for the state to track trends of taxes in each category. Kind of a gray area, I'd say... but hey, that's our wonderful NYS government!!

Thanks, Roz, and now I can sell candles as well!!! I have no "workmen" so I have had no interaction with "Workman's comp." That's for stores with employees, yes?

Do I sound stupid, or what? I have had this place for over 20 years, though, so I must not be too stupid.

Don't we all have classifications like that with the fed gov as well? I filled out a form not to long ago on a survey, one of those we are reqired to do by law.
 
I like Bob's answer. There are framers in California who have been put into the picture frame moulding manufacturer classification because they didn't know any better and that class has a really high worker's comp rate due to all the saws, planers, shapers etc.

Well, well, well, don't we learn something new every day!

I am SO relieved that "custom picture frame shops" and "picture frame shops, custom" have the same numerical designation cause I would never be able to figger which one was me!

Can I still plan on candles, if I switch from 453998 to 442299? And what about Roz??? The questions just keep on coming!
