Sold 2 pieces of 11x14 glass and foam core to a young man Saturday, Got a call from his wife on Monday saying I should have told her husband that the glass was sharp because she cut herself installing it, then yesterday when I wasn't here the husband called wanting us to know that she had had to have staples in her chin because of the sharp glass. I normally tell everyone that glass maybe sharp but I am not sure if I told him or not, was busy at the time. This is kind of like hot chocalate may be hot. It sounds like he wants me to pay for the staples I am not sure. Anyone else have an experience like this.
 
Oh brother. Sounds like an ad for a glass seamer - order that one from United right away and never let another piece of glass go out unseamed and then still ya gotta warn these people.

How did she manage to cut her chin?

You may be lucky if all you have to pay for is the staples.

I bet she stood the glass on end and held it with her chin while dusting off the art. Morons come in all shapes and sizes.:nuts::bdh:

I wouldn't think you have any liability - Geeze - :shrug::nuts:

I would also advise you to call your carrier of your liability Insurance just in case - one never knows what others might do but you shouldn't have to be involved with this sort of thing - that is why you pay these big premiums!!
 
this is typical STUPID people activity...which seems to be more the norm these days since COMMON SENSE seems to a dying art.... so they try to blame someone else for thier stupidity...plus it keeps the bottom feeding lawyers in business.
 
If you have liability then I would think TruVue has liability too.

I concur, people are stupid. That is why every piece of glass that goes out the shop unframed gets a swipe or two from the Seamer. And Mar is right, this is a perfect ad idea for the seamer!

Ray order it today. For less than $10 you could have saved yourself this nightmare. I have a terrible feeling that this is not the last you will hear from this couple.

Run it on the glass customers pick up and on any uniframed pieces you do. You are probably pretty lucky that this hasn't happened to you before. Should you have to go to court, god forbid, then call the local glass shops and hardware stores and find out what kind of signage they have in house to "warn" customers.
 
Yes, glass is sharp, but most consumers do not handle it often enough to do it safely. Before I became a framer, I cut my fingers picking up broken glass from the kitchen floor. But today, I handle glass all day long and carry razor blades in my pockets. Framers develop that sort of tactile skill. Consumers do not.

We normally seam coated glass, glass for metal frames, and we always seam the edges of glass we sell outside of a frame.

Alan’s right, call your insurance agent right away and give them a heads up.

It might not be a bad idea to call your lawyer, too.

Quite a few years ago, I took a course in “Hospital Law and Ethics” (an oxymoron if I’ve ever heard of one). The instructor, a lawyer, gave us some history lessons.

There was a guy using an extension ladder to paint a barn. He began early in the morning when the ground was frozen. As the day progressed, it warmed up and so the ground began to thaw. As it became slightly muddy and soft, one leg of the ladder sunk and tipped the ladder over and the painter fell some fifteen feet. He either broke his pelvis or became paralyzed (I can’t remember which).

Obviously, he sued the ladder manufacturer claiming that it was their responsibility to warn him that when frozen ground thaws it becomes soft. He won a bundle.

Next time you are near a ladder, read all of the warning labels on it. Each label warning is a response to a law suit.
 
Yes, there are a lot of stupid people out there, but some are smart enough to get what they want from their stupidity. Do you remember a few years ago when a woman sued McDonalds because she bought a cup of coffee, spilled it in her own lap and it was hot? I believe she received a settlement. As others have said, buy a glass seamer rather than taking any more risks. Of course a stupid person might also let it fall to the floor and complain that it broke!!!
 
For her to need staples, the gash would have had to have been very deep. If it were more superficial, they would have used sutures to minimize scarring.

My guess is that she fell on the glass while carrying it.

This happened to me about twenty years ago when the old metal clips and a piece of glass was so popular.The lady came to pick hers up and managed to cut her nose somehow.She sued us for plastic surgery and everything. The insurance company was out at that time over 25,000.The funny part was she was at least 75 years old and we couldnt see the cut that was less than a quarter inch long but she had a good lawyer.So i would definitely call the insurance company as soon as possible because sounds like they might try to pull something.

Why do we need to rescue idiots from themselves is beyond me. Do they place stickers on each knife or scissors??

we also run the seamer over any glass that leaves the shop unframed....but the stupidity of people is amazing...and you or the gov't can't protect them from everything...of course the gov't tries so more bureaucrats can have "jobs"...and what would the lawyers do if people quit being stupid and doing dumb things?
 
we have seamer but the problem with using it is that some times it is not perfect and will still leave a sharp spot or two. Then the use is deemed acceptance that you know there is a danger and did not do enough to resolve the sitiuation. In other words you accept responsibility. Worse in most cases than doing nothing. Advice from legal source. best advice is document on all copies of ticket that glass may be sharp in writing!!!!!!!

Some knife manufacturers do. I bought my wife a set of good kitchen cutlery for Christmas, and I remember seeing a warning label on the display box, but clearly not on the knives themselves.

There are always some people who will want to get something for nothing and blame whoever is available.

On the opposite side of Half Dome in the Yosemite Valley is a walkway at the top of the rocks that overlooks the whole area. It is a spectacular view and is the highest point around the area. A ranger told us that a few years prior to our visit, a woman was near the guardrail when a thunderstorm came up. She was struck by lightning and suffered some hearing loss.

She sued the Department of the Interior for not having warning signs at the overlook. The judge threw the case out siding with the defense by agreeing that it was an “Act of God” that caused her injuries rather than the fault of the government.

But, the judge quipped that she was free to sue God if she could find someone to serve the papers on Him.
 
we're talking about glass folks, you can seam the edges all you want. what happens if they break the glass and then cut themselves? are we still liable?

I think TruVue needs to include little stickers in the box of glass that say "Glass is sharp, use caution when handling" then we can just stick one of those on any framed order we want and especially on glass that is leaving the shop unframed.

Thats all McDonalds had to do. Their coffe cups now include a warning that says "contents may be hot" thats all it took and they are off the hook for any future liability.

Now that this issue has been brought up I think I'll just quickly print up some labes with sticky printer labels and put them on out going glass, I've sold over a 20 pieces of unframed glass this week alone.

I'd like to see her try to prove that the glass that cut her chin was actually the same piece that you sold her. That is if it was glass that made the cut.
 
I tell my customers not to lick the edges of
their glass, but they do it anyway. I'm getting
so tired of welding all their tongues back on.
 
SOME PEOPLE WILL TRY ANYTHING TO GET A BUCK OFF YOU for any stupid reason they can come up with...when I had my concret coatings business we got calls from people whose windshield was broken or car dented by one of our big trucks throwing arock or whatever thing they can come up with...We always bated them by asking which truck and how big a truck and when and where.....all kinds of ploys tried by them only to discover that we only had one truck ( a pickup ) and a cargo trailer...these idiots just went thru the yellow pages and called any company who may have a truck to try to shake them down for a dent repair or windshield replacement...guess it nworked sometimes...it was easy to trip them up if you asked the right questions..then gave them a bit of free advice and good words *****.
 
This is probably why you see all those dumb warnings on everything these days.

"Caution- blades are sharp" on a box of snap-blades - I hope they are sharp because blunt ones wouldn't be much use, would they?

My all-time best was a frozen microwave dinner which carried a warning that "when heated contents become hot and may cause injury"
Why didn't I figure that out??
 
Another funny one is bags of peanuts. They say "Warning: This product may contain peanuts!" (lawsuit/peanut allergy)
 
If I sell someone a pencil. I always warn them not to stick it up their nose as it makes your eyes water.

Won't catch me out. :p



Space is VAST. I mean really VAST. You may think it's a long way down to the newspaper shop, but that's peanuts compared to Space.......


Space may contain peanuts btw. In fact come to think of it, it contains everything.
 
The one I love is the Iron I recently bought. The warning label says not to iron the cloths while wearing them! No Dah!

I actually had a Soldier once that got treated for burns on his stomach and arms for doing just this. He said it took to long to get the blouse off and when he would put it on it would wrinkle again. He ended up getting punished for it, 30 days extra duty, 30 days confinement, for damaging gov't property.
