If all is as you say it is:

So my question is not did you hire a lawyer, but rather what percent did you agree to?

If you actually been declined by one, two or three lawyers, please give reason(s).

If you have vistied or spoken to lawyers plese give reson(s) why you passed on that shark and explain what kind of shark you are looking for.

I am currently in consultation with an attorny over all the issues we have discussed and a few that only today have come to my attention.

It seems my old boss is not even smart enough to keep his mouth shut when it is most advisable for him to. My finding a job would be doubly dificult if it were not for consered framers here on the grumble.

Husband just inventoryed a frame shop and is working up a offer for it so I WIll SURVIVE.

I did not mean shark in a bad way.

It's like the word tacky.

Y'know: When you are at the design counter and say, " Wow, that's tacky, but in a good way!"

I just found out tonight that The boss has started in on hs next victum. She call me in tears because she is mentally handicapped and is affraid she wont be able to find work if he lets her go. All I could tell her to do is start to look for another job and write everything down just like I did.

Thanks for all the good advice, I can only hope she takes it. From the looks of it he will be cleaning out the entire crew one at a time.

If this is for real, and the 'boss' thinks HE'S for real, and is about to just stroll in and fire an up-until-now OK mentally handicapped person, you can get together, the ex-employees, I mean, and serve this guy his own, uh, parts on a silver tray!! Get the lawyer in on this!!

This is totally none of my business, and I don't know why this guy bothers me, but he sounds like he needs something in his life to worry about besides the frame shop. And these are the types that are so full of themselves, they usually can't even see it coming.

Hope your lawyer's hungry, 'cause this guy's a cafe with a 'Open for Business' sign around his neck.

Jill,

Hiring a lawyer was the way to go. I would suggest that you continue to be proactive, in your documentation and communications with your lawyer. Of course, that is just an opinion. I also have some basis for my next suggestion, in that I'm not only a framer, but a school psychologist. In regards to your friend, I would offer that Charles is right on track. Of course your lawyer will know about the Americans with Disabilities Act, but he might also be able to find some useful insights under Section 504 and the Rehabilitation Act of 1973. Section 504 only applies to entities that recieve federal funding, but I think a creative lawyer would be able to make some pretty convincing arguments. If the shop you worked for received any federal funding for building renovation or making things more handicap accessible then he wouldn't even have to be creative!

Good luck!

Tom

Well now for chapter next.
I finally got my unemployment, The ruling was I was fired with out cause I did nothing detrimental to the business. Why do I feel like going Nah Nah Nah Nah? I will at lesast get the money but they still have 10 days to appeal the ruling. SO one more long wait to find out about that one. They pride themselfs on never having had to pay it. So I fully expect to end up in a hearing over it.
The boss has been giving me bad references, and actually had to call a store meeting to tell every one that the next person caught talking to anyone about me will be fired.

I will survive and make more money for myself than they ever could have cheated me out of. And I will win and get my back pay too.

Thank you all

I'm sure your attorney will be 'up' on the laws in Wisconsin.

I'd bring this to my lawyers attention!!

More good luck. Keep us informed.

Hi All

Yes I am still here. Just been dealing with a lot lately. My husband bought a frame shop and we take possesion of it May 1st. So my mind has been very occupied.

On the boss front the disabled clerk recieved her walking papers. So I have been trying to help her out with moral suport. Calculated it out and figure that I am owed about $2,000 for ilnterupted lunches, It appears that contrary to the bookkeepers the law says I have to take 1/2 hour of pay out of your check weather you took lunch or not...the law really says that if I did not recieve 30 UNINTERUPTED minutes for lunch they have to pay me for the lunch. that happened a minumim of 2 times a week. I also should have been payed for picking up plaques and running to have frames cut down. Apparently if you work you get paid in the lovely state of WI.

I will be calling to find out how working for the new shop effects my unemployment. But am putting that off until next week the lawyer is working on the the back pay issue. so only time will tell.

Other then the I now own a shop upset tummy Things are looking up.

Thanks for your inquiery

Jill:

Congratulations on your new ownership of the business, and best wishes for success.

As you go through "the system" regarding your former employer, keep careful notes. Remember that everything you learn about the law and the process will be helpful for you as an employer. Some laws don't seem to make sense until we fully understand them. And some laws just don't make sense at all -- but we still have to respect them.

I'm sure you'll work hard to be a fair and consciencious employer, since you've worked for one who isn't.

Cheers!
